Agreement to Terms
By accessing or using the services provided by Expert Facility Company (“we”, “us”, or “our”), you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use our services.
Interpretation and Definitions
In these Terms:
- “Client”, “you”, or “your” refers to the person or entity using our services
- “Service” means any work performed by Expert Facility
- “Agreement” means the entire agreement between you and Expert Facility
- “Project” means any work undertaken by Expert Facility on your behalf
Services
Expert Facility provides construction and maintenance services in British Columbia, including but not limited to:
- General contracting
- Commercial and residential construction
- Snow removal and salting services
- Building repair and maintenance
All services are subject to availability and our acceptance of your service request.
Quotes and Estimates
All quotes are:
- Valid for 30 days unless otherwise specified
- Subject to change based on site conditions
- Non-binding until accepted in writing
- Subject to HST/GST as applicable
Final costs may vary due to:
- Changes in scope
- Site conditions
- Materials costs
- Additional work requests
Payment Terms
Payment terms are as follows:
- Deposits as specified in the service agreement
- Progress payments as outlined in the contract
- Final payment upon completion
- GST/HST will be added as applicable
Late payments will:
- Incur interest at the maximum rate permitted by law
- Result in work stoppage until payment is received
- May result in legal action
Warranties
We warrant that:
- Services will be performed in a workmanlike manner
- Materials will be new unless otherwise specified
- Work will comply with applicable building codes
Warranty exclusions:
- Damage from normal wear and tear
- Modifications by others
- Inadequate maintenance
- Acts of nature
Liability
Our liability is limited to:
- Direct damages up to the amount paid for services
- Coverage provided by our insurance
- Claims reported within 30 days of discovery
We are not liable for:
- Indirect or consequential damages
- Pre-existing conditions
- Force majeure events
Insurance
We maintain:
- Commercial General Liability Insurance
- Workers’ Compensation coverage
- Professional Liability Insurance
Termination
Either party may terminate for:
- Material breach of agreement
- Non-payment
- Bankruptcy or insolvency
Upon termination:
- All outstanding amounts become due
- Work will cease immediately
- Materials remain our property until paid
Governing Law
These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada.
Dispute Resolution
All disputes shall be resolved:
- Through good faith negotiation
- Through mediation if necessary
- In the courts of British Columbia
- Under Canadian law
Changes to Terms
We reserve the right to modify these terms. Changes will be effective upon posting to our website.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Acceptance
BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND AGREE TO BE BOUND BY THEM.
